We think it’s important that we keep things simple and straightforward and so we have produced our Terms & Conditions (herein referred to as ‘Terms’) in a way that is easy to understand and in a format where you can find the area most relevant to you as easily as possible.
By visiting our site and/or purchasing something from us, you engage with the HCC
and agree to be bound by the following terms and conditions. These Terms apply to
all users of the site, including without limitation users who are browsers, suppliers,
customers, merchants, and/or content providers.
Please read these Terms & Conditions carefully before accessing or using our website.
By accessing or using any part of the site, you agree to be bound by these Terms.
Any new features or tools which are added to the HCC offering shall also be subject to these Terms & Conditions. You can review the most current version of the Terms at any time on this page. We reserve the right to update, change or replace any part of these Terms by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
By using this site, you warrant that you will not use our advice or products for any illegal or unauthorized purpose nor violate any laws in your jurisdiction (including but not limited to copyright laws).
A breach or violation of our Terms & Conditions may result immediate termination of our services to you.
All information provided by members is treated in the strictest confidence.
All HCC Experts are bound not to share with any third parties any information, sensitive or otherwise, provided by a Member during a treatment. For clarity this includes the submissions provided within any pre-treatment questionnaire, as well as any information shared and discussed during a video conference between a Member and an HCC Expert. All HCC experts cannot use any information provided by members for personal gain.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of our services, or access any contact on the website through which the service is provided, without express written permission by us.
Video calls may be recorded for training and monitoring purposes.
Video Conference Timing
All video call treatments with HCC Experts are specified for a specified period. Whilst you can expect your call to last the full time allocated, it may occur under exceptional circumstances that the discussion on a specific topic may conclude early. Early conclusion of calls do not warrant a refund either whether whole or in part. Should the member feel that the treatment has been naturally concluded, then they may ask questions of the expert outside of the treatment topic but should be aware that the Expert is under no obligation to oblige and may recommend another treatment.
Should you wish to an agree to conclude a call early, then the member will be required to confirm that they desire the call to be concluded before the call is ended.
It is at the sole discretion of the HCC Expert that a video conference may overrun. Should this be the case, you will not be liable for any additional fees. However, overrunning does not in any way set a precedence for future calls with either them or any other HCC Expert.
We always seek to work with our customers and support long-term relationships. We understand that from time-to-time cancellation of a treatment or session may be necessary. All we ask is that you provide us with 48-hours notice in order to allocate the session to another customer. We will then do our best to accommodate your session on another date and time. If you wish to cancel the session completely, please let us know and we shall provide a full refund.
HCC Savings Guarantee Calculations
The HCC Savings Guarantee is based upon the principle of identifying savings for a member. Given the nature of video-based advice, it is the responsibility for the member to implement, at their sole discretion’ any such savings advice. The HCC Expert does not remain liable for the financial outcome of any advice given.
The HCC Savings Guarantee is designed to provide members with the assurance that the advice that they are paying for will effectively be covered by the savings opportunities identified. Whilst this cost can be offset against improvement in bottom line costs, it may be the nature of some treatments and/or advice to advise action that can produce top-line improvements in revenue. Any identified revenue improvements will also count towards the financial benefits identified to the member. Any revenue opportunity will be valued at half the value of a savings opportunity. This is based upon the assumption that 50% of the revenue identified can flow through to the bottom line of the members business to offset the cost of the advice from the HCC Expert.
For clarity, a savings opportunity of £100 identified would be the equivalent to a £200 revenue generation opportunity and vice-versa when calculating the value of advice against an HCC Guarantee.
Savings and revenue opportunities need to be based upon a ‘normal’ period of operation for the hotel. We know that the challenges of 2020 have dramatically reduced the expenditure of many properties. Whilst an absolute saving is desirable, we benchmark identified savings and revenue potential based upon 2019 full year actual annual expenditures for the member’s business in reference. In the case where this information is unavailable, then savings potential assumptions will be made based upon reference information for similar sized and rated hotels.
All prices are inclusive of VAT. Any calculated comparisons between the value of guidance provided and the costs of the treatment will be exclusive of the VAT amount.
Claiming against the HCC Guarantee
Whilst we believe that our experts will identify savings and revenue opportunities for you, we know that we need a process for you to make a claim against the Guarantee should you feel that you have not covered the value of your fees.
You have up to 28 days from payment of any fee to make a claim under the HCC Savings Guarantee.
Any claims should be made in writing to email@example.com detailing why you feel that the commercial benefit to the value of the treatment or subscription has not been identified and providing the following information:

Treatment/Membership Fees (Excl. VAT)
Shortfall Claim (Fees minus Savings/Revenue benefit identified)
The HCC support team will respond to you to discuss your claim and arrange compensation where applicable.
Subscription Charge HCC Savings Guarantee
Our subscriptions are designed for hotels that want to start or maintain a regular savings program. As a result, advice provided will be based upon the expertise of an experienced HCC Purchasing expert as well as treatments they may recommend.
By the very nature of ongoing purchasing programs, savings opportunities will develop over the course of the membership. As a result, any review of the member benefits will be conducted every three months. For clarity, any claim against the guarantee for membership fees can only be made after a 3-month calendar period and every three months subsequently after that. As part of your regular reviews, your HCC Purchasing Partner will review your savings opportunities and ensure that the results of the support provided are regularly identified.
Savings opportunities are tracked and reviewed every three months. In any case where savings cannot be identified above the value of the fees, the difference will be refunded.
HCC Savings Guarantee Exceptions
By exception, and clearly identified, there are some services that are exempt from the HCC Savings Guarantee. These include the following:
Webinars: All webinar services are provided for advisory/educational purposes
One-on-One sessions: These sessions are provided for members to engage with our experts on a broader basis that they may do on a specific treatment. These sessions also act as a good follow-up to supporting members that may see further advice/guidance after a treatment has taken place.
Advisory/Educational Treatments: Some treatments are of an educational nature and for example, may focus on areas of development for an individual or hotel. For example, a treatment of Food Provenance would be supporting the hotel to address their local sourcing policy, but could not be accountable for establishing specific sales or savings targets.
Every paid transaction on our site is based around our members paying to have support via video conferences. All HCC Experts are acting in a self-employed basis and you are paying them for their time and engagement only - in which they will provide insight and expertise in their specialist subjects. Any advice and or guidance provided by an HCC Expert is based upon their experience and opinions. All advice is provided in good faith and based upon the information that you provide. The HCC Expert is in no way responsible for the implementation of any advice given and bears no responsibility or liability for the outcome in your business should any advice provided by them be enacted. The decision to act on any guidance provided is at the sole discretion of you as a member and therefor the Experts and HCC do not indemnify against any business impact, positive or negative, to the member.
Right to Refuse
From time to time, any HCC Experts may choose not to conduct a treatment should they identify a conflict of interest (or for any other reason) in doing so. In such event, the Member will be notified in advance of the treatment, an alternative HCC Expert will be offered, In any case where the alternative is not accepted by the member, all relevant fees will be refunded.
Change of Services & Pricing
Prices for our products and services are subject to change without notice.
We reserve the right at any time to modify or discontinue and service or products (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the service or product.
HCC Save Pro Fair Use policy
All Memberships are based upon a dedicated HCC Purchasing Partner being allocated to provide a member/hotel ongoing support. In the case of the HCC Save Pro membership option, the customer will be provided with the phone number and email of their HCC Purchasing Partner for unlimited support. What allows us to offer these ‘unlimited’ bundles is the result of detailed customer analysis. This means that, as long as everyone plays ‘fair’ with their support access, each individual member can benefit from flexible and diligent service.
Our Fair Use policy applies where the level of usage, or projected usage, is unreasonable and/or significantly in excess of what we would expect from a HCC Pro member. Should a member be deemed to be excessively using the service, then their membership may be terminated.
For clarity, the following maximum monthly threshold guidelines are provided as follows:

4 Video calls
This support is based upon an individual providing that support and therefore that Partner will be predominantly available during office hours on a weekly basis, with the exceptions of absences for holidays or sickness.
The HCC Market is a supplier referral service. Recommendations made by the HCC are without liability.
Products and services available via this service are from third-parties. Third-party links or contact information directing you to third-party sites, products or services may not be affiliated with us. We are not responsible for examining or evaluating the products, services, content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.
We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-parties. Products or Services
Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and may be subject to our return or cancellation policies.
We have made every effort to display as accurately as possible the colours and images of any products that may appear on our site. We cannot guarantee that your computer monitor's display of any colour will be accurate.
We reserve the right, but are not obliged, to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. Billing Accuracy & Account Information
We reserve the right to refuse any order or booking you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates so that we can complete your transactions and contact you as needed.
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Termination of service
These terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
